1. SCHOOL’S OBLIGATIONS
1.1 PROVISION OF COURSE
Cretan Eagle Aviation Limited, hereafter referred to as “CEA”, will provide teaching materials, practical training and instruction, ground and flying instructors, aircraft, and equipment as relevant and appropriate to the nature of the Course. CEA has no further responsibility and gives no guarantee that the Student will achieve any qualification.
1.2 COURSE VARIATION AND TRANSFER
CEA may at any time or times vary the content of or otherwise alter any course provided that such variation does not of itself prevent the Student attaining a standard advertised as attainable under such course.
1.3 LENGTH OF COURSE
The duration of the course will be as stated in the respective Agreement. The School may, in its discretion, extend the duration of the Course as it sees fit to take account of weather conditions, the ability of the student, or otherwise as CEA shall deem requisite or expedient.
2. STUDENT’S OBLIGATIONS
2.1 FEES
2.1.1 Payment Terms: The Student / Guarantor will pay the fees for the course at the rates and in accordance with the payment times set out in the Payment Schedule and any balance shall be paid in full prior to the course commencement.
2.1.2 Form of Payment: Payment may be made in cash, by PayPal or by bank transfer. Checks will be accepted for payment only if received by CEA not less than 7 days in advance of the due date for payment in accordance with any relevant invoice. All bank charges are the responsibility of the Student / Guarantor.
2.2 ADDITIONAL FEES
The Student / Guarantor shall pay CEA all additional fees which result from an extension of the Course pursuant to clauses 1.2 or 1.3, as they incur at the prices in force at the time.
2.3 EXAMINATIONS
The Student shall comply with all the relevant regulatory authority requirements for the booking of examinations that he/she is required to take pursuant to the course.
2.4 APPEARANCE AND BEHAVIOUR
2.4.1 During the Course hours the student shall behave at all times in an appropriate manner.
2.4.2 Observe any regulations and instructions from time to time issued by CEA or any of its officers or instructors.
2.4.3 Not behave in a manner likely to damage the reputation of CEA or to compromise the safety of others in any way.
2.5 DAMAGE TO CEA PROPERTY
The Student / Guarantor shall be responsible for and shall reimburse CEA for the cost of repairing or replacing any loss or damage to any CEA property or property leased to CEA caused by the willful conduct or negligence of the Student save to the extent covered by the insurance referred to in Clause 3.1
2.6 AGE AND QUALIFICATIONS
The Student warrants that he/she will have reached the age of 17 by the commencement date that he/she has attained the entry requirements appropriate to the Course,
as published in the Training Brochure, and that he/she is eligible to take the relevant regulatory authority skill tests and examination.
3. INSURANCE AND LIABILITY
3.1 INSURANCE BY CEA
CEA undertakes to effect and maintain an all risks aviation liability insurance and in particular:
3.1.1 Additional Insured: CEA shall include the Student as an additional insured with a severability insurance policy but this insurance does NOT cover the Student for his/her property and the Student is strongly advised to make his/her own arrangements for this cover.
3.2 LIABILITY
CEA shall not be liable to the Student in respect of his/her death, personal injury or other loss howsoever caused.
3.3 PROPERTY DAMAGE
No liability for Property damage. CEA shall not be liable for loss or damage to property of the Student howsoever caused.
4. TERMINATION
4.1 TERMINATION BY CEA
This agreement and/or the provision of training by CEA to the Student if:
4.1.1 The Student / Guarantor fails to pay any sum payable by him/her promptly upon the same falling due or commits any other breach of any of his/her obligations under this Agreement or;
4.1.2 In CEA’s opinion the conduct of the student is inappropriate or represents an unacceptable safety hazard or is otherwise unsuited to the course or to piloting an aircraft (and CEA’s discretion and decision in any respect shall be absolute and final).
4.2 TERMINATION BY STUDENT
This Agreement may be terminated by the Student at any time, according to the terms referred in the Agreement signed.
4.3 EFFECTS OF TERMINATION
If this Agreement is terminated for any reason the Student / Guarantor shall remain liable for all course and accommodation fees owing by him/her to CEA at the date of termination and shall not be entitled to any refund of monies paid in advance to CEA in respect of Course fees not yet incurred at that date. A refund is offered only in case of Students death and only for the remaining part of his/her Course minus 500-euro administration fee.
4.4 ACCRUED RIGHTS
Any termination of this Agreement shall be without prejudice to any rights and obligations of the parties, which have accrued at the date of such termination.
5. CONFIDENTIALITY
5.1 COPYRIGHT
The Student undertakes without limitation in time:
5.1.1 The use the Course Materials only for the purpose of the Course.
5.1.2 Not to copy or reproduce in any way in whole or in part the Course Materials save during and for the purposes of the course.
5.1.3 To retain all Course Materials in his/her personal possession and ownership and not to distribute the same to any other person provided that upon written request of CEA at any time the Student shall deliver up the Course Materials provided to the Student under this Agreement and any copies thereof. On completion of the course, materials used during the course may be purchased.
6. GENERAL
6.1 ENTIRE AGREEMENT
This Agreement sets out part of the Agreement and understanding of the parties relating to the subject matter of this agreement and supersedes all prior agreements, understandings or arrangements.
6.2 VARIATIONS TO AGREEMENT
Any variation or amendment to this agreement shall only be valid if in written form signed on behalf of CEA and by the Student. Such variation shall be deemed to be incorporated into this Agreement and shall be affective from the date of such variation or amendment unless otherwise stated.
6.3 FORCE MAJEURE
CEA shall not be liable for any failure or delay in performance of this Agreement which is caused by circumstances beyond its control.
6.4 JURISDICTION
This Agreement shall be governed and construed in all respects by Greek law and each of the parties irrevocably submits to the exclusive jurisdiction of the Greek Courts.
6.5 NO WAIVER
No time or other indulgence allowed by other party to the other indulgence allowed by other shall constitute any waiver of any right or remedy and any choice of remedy shall be cumulative and not exclusive.
7. HOUR BUILDING
7.1 LIMITATIONS
The Student shall assure CEA that, during any hour building programme, all flights undertaken shall be for the purpose of gaining flight experience only for the issue, renewal or revalidation of any licence or rating and that the aircraft shall not be used for any commercial purposes, including Air Taxi, Freight Carriage or Flight Instruction and all other flight for hire or reward, whether these be Commercial Air Transport or Aerial Work.
7.2 RESPONSIBILITY
The Student shall accept full responsibility for ensuring that the conduct of the flight is in accordance with regulations and procedures in force at the material time and that CEA shall not be held liable for any infringement of those regulations.
By signing this document, the Student/Guarantor, consent to the personal data above to be shared with the HCAA and other governmental agencies, if needed, for the time period specified by the law and GDPR.
